Terms and Conditions (2025)

These terms and conditions together with the application form makes the complete terms and conditions that apply to client’s participation in Emmih Company Limited (hereinafter the service) and supersedes all other agreements that is entered or will be entered into between the client and Emmih Company Limited in relation to Emmih Company Limited services (defined and outlined below). By executing this document, the client agrees that he or she strongly affirms to have read and understood the terms and conditions set and agrees to be bound by the said terms and conditions.

DEFINITION AND INTERPRETATION

In the agreement unless the context otherwise suggests, the following words and expressions shall have the following meanings.
-“Hydrogen Hybrid” means the state assumed by a vehicle after a hydrogen generating retrofit is installed in a vehicle’s normal internal combustion or a turbine engine with a purpose for both the convectional fuel and the hydrogen to be used for locomotion either in shifts or simultaneously.
-“Electric hybrid” means the state assumed by a vehicle after an electrical storage device or battery bank is installed in a vehicle’s normal internal combustion or a turbine engine.
-“Hydrogen Engine” means the unit that provides power for locomotion, turning power or mobility that uses hydrogen solely as the primary fuel.
-“Goods and Services” means the products and/or services which we offer for sale either in our websites, our business outlets or marketed by our company or businesses
-“Retrofit” means a hydrogen generating unit having been installed in a vehicle to run as part of the vehicle’s original installed components.
-“Performance” means doing some task causing an improvement in any way of the product, equipment, goods or services.
-“Mileage gain” means the reduction in the fuel consumption in relation to the distance covered or time taken for a machine or the equipment for a given amount of fuel in comparison to an initial or original state before a service is initiated.

• “Emissions” means gases released to the atmosphere from an engine.
  -“Installation cost” means to be paid by the buyer to cater for the installation services.
  -“Servicing fees” means the amount of money charged for replenishments, and maintenance of a given product or equipment.
  -“buyer or client” means the person who seeks to have a business engagement with us for either goods purchases or services rendering.
  -“Us/ We/Our” means the appointed persons, technicians affiliated to Emmih Company which affiliates to Jowshu Garage and Alfad Engineering.
• “Warrantee” means the time in which a product or a good can be maintained or serviced without a requirement for a servicing fee.
  -“electrochemical” means the breakdown of water through electrical current or fusion into its separate elements which are oxygen and hydrogen.
• “Hydrogen” means a combustible gas usually comprised in the earth’s atmosphere at 0.00005% which can be generated through electrochemical means aiming at splitting the main components of water which are oxygen and Hydrogen.
  -“Hydrocarbons” means the combustible chemicals derived from the petroleum products which are in most cases the compounds of hydrogen and carbon.
  -“HHO” means the combined gases that come from the splitting of water through the electrochemical means.
  “Electrolytes” means the solution of chemicals used to facilitate the electrochemical processes.
  “Electric car” means the vehicle that uses the electrical power storage to provide energy to an electrically driven motor which in turn turns to provide a mechanical force for mobility.
  -“Good/equipment/ Product” means the items involved for sale, repair, reconstruction, modification or redesign.
• In this agreement where all recitals are inclusive unless the context otherwise requires
• The singular words shall bear the meaning for the plural words and the vice versa

Terms

By subscribing to our services through the phone call, form request or any other form, we believe that you have understood and agreed to all our terms and conditions. We thereby take no liability during our services in your machinery and equipment. This agreement will be termed binding when a client seeks for our products, goods or services

Although we take great care while we restore electronics units, we do not take liabilities to electronics units, power banks or batteries that may be damaged during the servicing.

All the machinery, equipment, parts, automobiles that fail to be reclaimed within 15 days of repair/service completion may attract interest of 15% the value of the electronic unit. Items that remains for more than 90 days without collection may be disposed and the amount realized are used to settle for the accrued charges.

We not liable to data loss during the repair service.

We believe that we approach and attempt our servicing to an already broken down system, we therefore believe that the extents of breakdown can not be quantified besides through our own analysis.

We sell our goods and services according to verbal or written agreement biding between we (the seller or the services provider) and the buyer (referred here as the product purchaser or the services seeker).

The buyer shall seek advice from their preferred mechanics or the insurance agents in regards to any changes in which our products, goods and services shall cause to their machinery, equipment or appliances.

Our staff bears no liability in a personal capacity before, during and after goods or services are rendered to the client.

It shall be upon a client to take care of their taxes, insurances, safety and any other procedural checks and enhancements as far as our goods and services are concerned. Always do your due diligence when it comes to purchases, retrofitting, servicing, conversions and any other services for business or personal use since we shall not admit or bear any liabilities.

Our main websites shall be: www.emmih.com, www.jowshu.com and the official email addresses shall be emails that come from these 2 websites e.g. sales@jowshu.com.

This agreement is governed by the laws of Kenya

How long we retain your data
